Welcome to www.euromonitor.com (‘the Site’), which is owned and operated by Euromonitor International PLC (Euromonitor).

These Terms and Conditions (‘Terms’) govern the use of this Site and any order for content that you place, in particular, the rights you acquire to use such content. By using the Site, regardless of whether or not you choose to register, you are agreeing to be bound by these Terms. You should therefore read them carefully to understand your rights and liabilities before placing an order or using the Site. Alternatively, if you do not wish to be bound by these Terms, you should not use the Site.

1 USE AND LIMITATIONS OF USE OF CONTENT

    Euromonitor provides some content on the Site for free (e.g. executive summaries of reports and articles) and some content for purchase (e.g. full reports, books).

Permission to use free content

    1.1 You can use the content that we make available for free on the Site for your own reference use only in connection with your business to view online, download one or more items of it onto the drive of one hardware device or print one copy of one or a reasonable number of items, provided you keep intact all and any copyright and proprietary notices. All other rights in relation to our free content are reserved.

Permission to use purchased content

    1.2 When you buy any of our content in digital form, what you are buying is the right to use it (or extracts from the same) for your own reference in connection with your business in the following ways only:-

  • to download one copy of that digital content in an available electronic format
  • to store that content in electronic format on the drive of one hardware device;
  • to print out one copy of that digital content;
  • to manipulate any statistical data that is provided with a report in accordance with the functionality that Euromonitor provides (e.g. to show different values such as growth rates, per capita values, or different currencies),

provided that you keep intact all and any copyright and proprietary notices

Restrictions for use of content

    1.3 Any rights not expressly granted in these Terms are reserved. This means that you may not use the content in any way not permitted above, in particular:

  • You may not offer the content for resale.
  • You may not scan, photocopy, fax, or in any other way reproduce or copy the content.
  • You may not share the content with anybody else.
  • You may not distribute the content whether by electronic mail, over any network or otherwise.
  • You may not upload the content to any database or server.
  • You may not display the content on any website or intranet.

When you buy any of our content in print on paper format, you are permitted to use it in accordance with the copyright notice included with such content and in accordance with copyright laws.

Requests for permission

    1.4 If you wish to use our content in any way not expressly permitted above, you must first request written permission from Euromonitor. Euromonitor may grant or withhold permission for such use at its own discretion. If Euromonitor grants you permission for such use, in addition to any other conditions applied, you must attribute the content to Euromonitor in the following form: “source: © and database right Euromonitor International PLC 200[/]. All rights reserved.

2 ACCESS AND REGISTRATION

    2.1 You are free to browse many areas of the Site without registering. However, if you want to access certain parts of the Site, then you will need to register.

    2.2 You must ensure that all the information you provide when you register or place an order is true, accurate, current and complete in all respects.

    2.3 If you change your registration details, you must let Euromonitor know by sending an e-mail to info@euromonitor.com

    2.4 Each registration is for a single user only. Please do not share your registration details with any other person as you will be held responsible for all activities that occur under your password or account with or without your knowledge.

    2.5 If you become aware of any misuse or unauthorised use of your log in details, then you must inform Euromonitor immediately by sending an email to info@euromonitor.com

3 CONTENT AND SERVICES AVAILABLE ON THE SITE

Free content

    3.1 Euromonitor makes content available for free on the Site including executive summaries of reports, podcasts and some articles. Please see Use and Limitations of Use of Content for details on how you are permitted to use this content.

Content for purchase

Reports

    3.2 Euromonitor offers for purchase market reports, country reports, global reports and company profiles (‘Report(s)’) in digital format for download from the Site. For details of how you can use this content please see Use and Limitations of Use of Content .

    3.3 Reports are available in digital and print format. Digital Reports are available for download and use in certain specified formats, for example, Microsoft Word, Adobe PDF, Microsoft Powerpoint, podcast or video. It is your responsibility to check which format suits your needs best and which will enable you to successfully receive and access any purchased download before you place an order. Please note that from time to time Euromonitor may modify the formats in which the Reports are available, so you should always check before making a purchase.

    3.4 When you purchase a digital Report, you may also be given access to statistical data at no extra charge. Where available, statistical data can be downloaded in Microsoft Excel spreadsheet format. Its use is also subject to the Use and Limitations of Use of Content .

Books

    3.5 Euromonitor also offers books for purchase which can be found in the Bookstore .

    3.6 If you need more immediate access to a book, Euromonitor may be able to provide it in digital format. Please contact Euromonitor via info@euromonitor.com to make your request

Other Euromonitor content and services

    3.7 Euromonitor offers additional services (including consultancy services and database subscriptions (for both academic and commercial purposes)). 4 PURCHASING CONTENT

Eligibility to place an order

    4.1 To be eligible to place an order for content on the Site, you must:

  • be placing an order on behalf of your business;
  • register by providing your real name, address, phone number, e-mail address and other required information;
  • possess a valid credit or debit card issued by a card issuer acceptable to Euromonitor (i.e. Visa, Mastercard and American Express).

Making a contract

Online

    4.2 The following steps have to take place before a contract is made online between you and Euromonitor:

  • You place your order on the Site by pressing the ‘Buy Now’ button. This button appears at the ‘Checkout’ page after you have provided your card details.
  • You will see an on-screen acknowledgement that your order is complete. Euromonitor will also send you an e-mail acknowledging the content that you have ordered and the total cost of your order.
  • In respect of digital Reports, Euromonitor accepts your order, and therefore the contract is made between you and Euromonitor, when Euromonitor sends you an e-mail containing log in details to access your purchased Report(s). In respect of print Reports, Euromonitor accepts your order, and therefore the contract is made between you and Euromonitor, when Euromonitor dispatches the same to you.
  • In respect of print books, Euromonitor accepts your order, and therefore the contract is made between you and Euromonitor, when Euromonitor dispatches the book(s) from its warehouse. In respect of digital books, Euromonitor accepts your order, and therefore the contract is made between you and Euromonitor, when Euromonitor sends you the email with the link to the book(s).

Offline

    4.3 If you choose to order content offline, the following steps have to take place before a contract is made between you and Euromonitor:

  • You place your order by completing and returning to Euromonitor the order form, which includes your payment details. The order form can be downloaded by clicking the ‘Buy Offline’ button.
  • In respect of digital Reports, Euromonitor accepts your order and therefore the contract is made between you and Euromonitor when Euromonitor sends you an e-mail containing log in details to access your purchased Report(s). In respect of print Reports, Euromonitor accepts your order, and therefore the contract is made between you and Euromonitor, when Euromonitor dispatches the same to you.
  • In respect of print books, Euromonitor accepts your order, and therefore the contract is made between you and Euromonitor, when Euromonitor dispatches the book(s) from its warehouse. In respect of digital books, Euromonitor accepts your order, and therefore the contract is made between you and Euromonitor, when Euromonitor sends you the email with the link to the book(s).
  • In respect of print books, Euromonitor accepts your order, and therefore the contract is made between you and Euromonitor, when Euromonitor dispatches the book(s) from its warehouse. In respect of digital books, Euromonitor accepts your order, and therefore the contract is made between you and Euromonitor, when Euromonitor sends you the email with the link to the book(s).

    4.4 These Terms will form part of the contract between you and Euromonitor for the purchase of content, irrespective of whether the contract is concluded online or offline.

    4.5 The contract between you and Euromonitor will be concluded in English. Euromonitor does not keep a record of any contract with you, so you should print and keep a copy of these Terms and the e-mail confirmation of your purchase or your order form each time you place an order.

Cancelling your order/terminating the contract

    4.6 Euromonitor may decline your order for any reason, in which case Euromonitor will send you an e-mail telling you so. If the reason for declining your order is because Euromonitor cannot obtain authorisation of your payment details for any reason, then Euromonitor may invite you to pay by another method.

    4.7 Although Euromonitor tries very hard to ensure that all information on the Site is accurate, occasionally errors may occur. As such, if Euromonitor discovers a material error in the price or description of any content that you have ordered, Euromonitor will let you know and ask whether you wish to continue with your order or cancel it.

    4.8 To avoid any doubt, as this Site and its content is intended for business use, you do not have an automatic right to cancel your contract with Euromonitor.

    4.9 Euromonitor reserves the right to terminate any contract with you if your payment is not processed for any reason, but you have nevertheless received the content you ordered. In such an event, Euromonitor may on notice to you withdraw your right to use such content (as described in Use and Limitations of Use of Content ) and require you to delete or return such content as appropriate.

5 PRICES AND PAYMENT

    5.1 The prices for content quoted on the Site do not include VAT or delivery. If you buy online, you will find the total cost of your order, with price, VAT (where applicable) and delivery itemised, in your ‘Shopping Cart’ before you submit your order. If you buy offline, the applicable delivery charges are specified on the order form

    5.2 Orders shipped to a UK address will be invoiced in Sterling (£). Orders shipped to the EU will be invoiced in Euros (€). All other orders will be invoiced in US Dollars ($).

    5.3 Euromonitor currently accepts payment by the following credit cards: Visa, Mastercard and American Express. You confirm that the credit card you use to make payment to Euromonitor is yours.

    5.4 Subject to credit card authorisation, Euromonitor takes payment from your credit card once you have entered your payment details and clicked the ‘Buy Now’ button, or if you are buying offline, once you have confirmed your payment details. In the event that Euromonitor is unable to supply the content you have ordered, Euromonitor will let you know as soon as possible. In such event, Euromonitor will give you a full refund if payment has already been taken.

    5.5 5.5 If you are buying offline and you have completed the order form incorrectly, Euromonitor will contact you to bring this to your attention and to ask you whether you wish to proceed with your order.

6 ACCESS TO/DELIVERY OF PURCHASED CONTENT

Access to digital Reports and books

    6.1 Once your payment details have been confirmed (subject to any delays beyond Euromonitor’s control) Euromonitor will send you an e-mail containing your log-in details. You should use these to access your content from the Site. Your content will be available for you to use, in accordance with the usage restrictions set out in Use and Limitations of Use of Content .

    6.2 Provided that any download Euromonitor has provided to you is not defective, risk of loss of and damage to the content you have purchased passes to you once your download is complete.

Delivery of print Reports and books

    6.3 Euromonitor, using a courier, can deliver purchased print Reports and/or books to any country in the world. If you buy online, the cost of delivery is detailed in your ‘Shopping Cart’. If you buy offline, the applicable delivery charges are specified on the order form.

    6.4 Orders are dispatched by the courier within 3 working days of the order being placed. Upon arrival at the delivery address, an adult aged 18 years or over must be present to sign for the delivery.

    6.5 If no one is at the address when the delivery is attempted, the courier will retain the delivery and leave notification of delivery. You should call the telephone number on the notification to re-schedule a delivery.

    6.6 When you re-schedule a delivery, the courier will attempt to re-deliver your order free of charge. If the courier’s reasonable attempts at delivery have been unsuccessful and the courier returns the order to Euromonitor, Euromonitor will notify you. It will then be your responsibility to re-arrange delivery at your own cost.

    6.7 Euromonitor makes every effort to deliver orders within the estimated timescale of 1 week. However, delays occasionally occur due to unforeseen circumstances. If Euromonitor or its courier has to cancel or materially delay the delivery for any reason, Euromonitor will try to contact you as soon as possible. Euromonitor shall be under no liability for any delay or failure to deliver your order within the estimated timescale.

    6.8 Risk of loss of and damage to the print Reports and/or book(s) passes to you when the person at the delivery address signs for the delivery.

7 DEFECTIVE CONTENT

    7.1 If a digital Report and/or book is defective (e.g. it is corrupted) or if a print Report and/or book has been damaged in transit, then please contact Euromonitor via info@euromonitor.com to notify us. You will be entitled to a replacement. This constitutes Euromonitor’s sole liability to you for any defective content you have purchased.

8 THIRD PARTY SOFTWARE

    8.1 You acknowledge that you might need to download and activate certain third party software in order to download, view and use any of the digital content provided on the Site (e.g. Adobe Reader). This software will be clearly identified on the Site.

    8.2 In order to use such third party software or technology you may have to explicitly accept the terms of a license agreement with that third party. You acknowledge that Euromonitor has no responsibility or control over such third party software or their licence terms.

9 PRIVACY POLICY

    9.1 Euromonitor takes your privacy seriously. Please read the Privacy Policy to see what personal information Euromonitor collects and how it deals with this information.

10 LINKS

    10.1 The Site may include links to third party websites such as useful research websites and promotional partners. Euromonitor has not reviewed these third party websites and does not control and is not responsible for these websites or their content or availability. Euromonitor therefore does not endorse or make any representations about them, or any material found there, or any results that may be obtained from using them.

    10.2 If you decide to access any of the third party websites linked to the Site, you do so entirely at your own risk. In particular, any personal information you give to a third party website will be dealt with in line with that third party’s privacy policy, not Euromonitor’s, so please ensure that you read their privacy policy before you provide any personal information.

    10.3 You may link to the Site, provided:

  • the Site is not loaded into frames on your website and is not otherwise passed off as your own content; and
  • your website or service does not misrepresent its relationship with Euromonitor or present false information about Euromonitor.

    10.4 Euromonitor reserves the right to withdraw linking permission at any time without prior notice.

11 YOUR USE OF THE SITE

    11.1 Euromonitor encourages your use of the Site and our content on the Site. However, Euromonitor requires that your use of the Site is lawful. Consequently, you may not use the Site for any illegal purpose and in particular you will not interfere with or disrupt the Site or servers or networks connected to the Site, or disobey any requirements, procedures, policies or regulations of networks connected to the Site.

12 INTELLECTUAL PROPERTY

    12.1 You acknowledge that all copyright, trade marks and all other intellectual property rights in the Site and the content made available via the Site, will at all times remain vested in Euromonitor or its licensors.

    12.2 For information on how you are permitted to use the content made available on the Site, please see Use and Limitations of Use of Content .

    12.3 The trade mark ‘Euromonitor’ is owned by Euromonitor. All other brand names and trade marks that appear on the Site are trademarks or trade names of their respective holders. No permission is given in respect of the use of any of these brands or marks, and any such use may constitute an infringement of the holder’s rights.

13 LIMITATIONS AND DISCLAIMERS

    13.1 The Site is intended for information purposes only and as such no information provided on or via the Site constitutes advice or recommendations. You should not rely on any information provided on or via the Site to make any decision. If you do, Euromonitor is not liable for any loss or damage that may result.

    13.2 Euromonitor promises that it has permission from the original rights owners to allow you to use the content available via the Site, in accordance with these Terms.

    13.3 Euromonitor promises to operate the Site with reasonable skill and care and to use reasonable endeavours to correct any faults of which it is aware.

    13.4 Although the Site is provided in good faith and Euromonitor tries to ensure that the information on the Site is accurate and complete, Euromonitor cannot and does not guarantee the accuracy, integrity, quality or completeness of the content available via the Site or its usefulness for any particular purpose. Euromonitor does not accept any liability which may arise as a result of any errors or incomplete information in such content.

    13.5 Euromonitor does not make any promises about the availability of the Site or promise that your access to the Site or our content will be delivered uninterrupted, timely or error-free. In particular, Euromonitor disclaims any liability in connection with any technical problems you may experience with the Site which may result in interruptions to the Site, or any bugs or viruses in any content you download or software you use to download the content, the Site or the server that makes it available. In this respect you agree that it is your responsibility to install suitable anti-virus and security software on your computer hardware and other devices to protect against any such bugs or viruses, including but not limited to Trojan horses, time bombs, cancelbots or any other form of programming routine designed to damage, destroy or otherwise impair a computer's functionality or operation. Any content downloaded or otherwise obtained through the use of the Site is done at your own risk and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such content.

    13.6 Occasionally Euromonitor is unable to perform its obligations under these Terms due to circumstances beyond our reasonable control. In such circumstances including, but not limited to, system failure, fire, flood, earthquake and other natural physical disasters, strikes, trade disputes, lock outs, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war, Euromonitor’s inability or delay in performing its obligations will not be deemed to be in breach of contract.

14 INDEMNITY

    14.1 You agree to indemnify, defend and hold harmless Euromonitor, its directors, officers, employees and licensors from and against any claim, liability, cost, damage or loss Euromonitor may incur (including reasonable legal fees) as a result of any actions you take which disrupt access to and/or functioning of the Site and/or any breach by you of your obligations under these Terms, including but not limited to any breach by you of the permissions granted to you under Use and Limitations of Use of Content .

15 RIGHTS AND REMEDIES

    15.1 Nothing in these Terms will restrict any of your statutory rights or Euromonitor’s liability for death or personal injury resulting from Euromonitor’s negligence.

    15.2 Euromonitor’s maximum liability arising out of any order placed by you via the Site will be limited to either: (i) in the case of any defective content, the replacement of such content; or (ii) in any other case, the retail price of the content for which you have paid.

    15.3 To the fullest extent allowed by law, Euromonitor will not be liable for any direct, indirect, incidental or other type of losses that you may suffer, whether relating to your downloading, purchase or use of content, or to the use of the Site, including loss of business profits, loss of anticipated savings, wasted expenditure or any other indirect or special damages.

16 GENERAL

Changes to these Terms and the Site

    16.1 Euromonitor may change these Terms at any time by sending you an e-mail with the modified Terms or by posting a copy of them on the Site. Any changes will take effect seven (7) days after the date of the e-mail or the date on which Euromonitor posts the modified Terms on the Site, whichever is the earlier. Your continued use of the Site after that period expires means that you agree to be bound by the modified Terms.

    16.2 To ensure that you are aware of the most up to date version of these Terms, you will be asked to read and accept these Terms each time you place an order. Euromonitor also recommends that you print and keep a copy for your records. To print, please press CTRL + P.

    16.3 Euromonitor may at any time make changes to the Site and the details displayed on it (including content and prices).

Severability

    16.4 If any of these provisions is deemed invalid, void or unenforceable that provision will be deemed severable from the rest and will not affect the validity and enforceability of any remaining provisions.

Entire agreement

    16.5 These Terms govern Euromonitor’s relationship with you and represent Euromonitor’s entire agreement with you in connection with your use of the Site and the content made available via the Site.

Assignment

    16.6 You may not assign, sub-license or otherwise transfer any of your rights under these Terms.

Waiver

    16.7 If you breach these Terms and Euromonitor chooses to ignore your breach, Euromonitor will still be entitled to use the rights and remedies available to it at a later date or in any other situation where you breach the Terms again.

Exclusion of third party rights

    16.8 These Terms do not create any right enforceable by any person who is not a party to this Agreement.

Governing law and jurisdiction

    16.8.1 Any disputes or claims arising out of or in connection with the contract are governed by and construed in accordance with the laws of England and Wales.

    16.9 If a dispute arises out of or in connection with this contract, both you and Euromonitor will attempt to settle it by mediation in accordance with the Centre for Dispute Resolution (CEDR) Model Mediation Procedure.

    16.10 If either or both you and/or Euromonitor refuse to initiate the mediation procedure within 14 days of the dispute arising or if you and Euromonitor both fail to agree terms of settlement within 30 days of the initiation of the procedure, either of you or Euromonitor will be free to initiate proceedings in the courts of England which will have exclusive jurisdiction to deal with such dispute.

    17.1If you have any complaints, please contact Euromonitor via e-mail at info@euromonitor.com or by post (at the address below) and Euromonitor will do its best to resolve these.

2 THE INFORMATION EUROMONITOR COLLECTS AND HOW IT IS USED

2.1. Euromonitor collects personal information from you when you:

  • Register to use the Site. If you register to use the Site, Euromonitor collects personal information such as your name, company name, username and e-mail address.
  • Place an order. If you place an order, Euromonitor will also collect further information, including your telephone number and your address.
  • Sign up to an e-alert. If you sign up to an e-alert service, Euromonitor collects personal information such as your name, company name, country of residence and the topics in which you are interested.
  • Contact Euromonitor. If you contact Euromonitor via the Site, for example to request a speaker or for any other reason, Euromonitor collects personal information such as your name, company name and contact details as well as any other personal information you disclose in your message to us.

2.2. Euromonitor uses the personal information it collects:

  • to personalise the service you receive so that the Site recognises you on subsequent visits and to send you marketing information on new products, research and special promotional offers;
  • to process your order; and
  • to respond to your queries.

3 INFORMATION SHARING AND DISCLOSURE

Euromonitor does not sell or rent your personal information. Euromonitor may, however, give information about you to the following, for the express purposes set out below:

if you register to use the Site:

3.1 to Euromonitor’s employees and agents (who may be operating outside the European Economic Area (“EEA”) for them to administer any accounts or services provided to you through the Site;

if you place an order:

3.2. to Euromonitor’s employees and agents for them to provide support services in connection with the Site, for example delivery services;

3.3 and if you pay by credit card, to Datacash Limited in order for them to authorise and approve your card and to Barclays Merchant Services for them to process the card transaction;

transfer of business

3.4 if ownership or operational control of all or part of the Site were transferred, whether as part of the sale of the Euromonitor business or otherwise, Euromonitor may disclose your personal information to the transferee. If that happens, Euromonitor would require them to use your information in a way that is consistent with this Privacy Policy.

If Euromonitor does give your information to the third parties set out above, Euromonitor will always require they adhere to the same security procedures that Euromonitor follows itself.

4 LEGAL REQUESTS

Euromonitor may need to disclose personal information to protect Euromonitor and Euromonitor’s licensors’ rights and property or to comply with any applicable law or valid legal process.

5. TRANSFER OF INFORMATION OUTSIDE EEA

5.1 Euromonitor has offices worldwide. As such, your information may be transferred to, stored at, or processed at a destination outside the EEA within the Euromonitor group of companies.

5.2 By submitting your personal data, you agree to this transfer, storing or processing. Euromonitor will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.

6. AGGREGATED INFORMATION

Euromonitor may share non-personal aggregated statistics data about visitors to the Site and sales and traffic patterns with our partners and other third parties. Just to be clear, this information does not identify users in any personal capacity; it just gives generalised information about the users of the Site.

7. COOKIES AND OTHER TRACKED INFORMATION

7.1 While on the Site, certain information is automatically logged about how you are using the Site. This information may include the URL of the website which linked you to the Site, your IP address and the pages you visit while on the Site. The IP address indicates the location of your computer on the internet. IP addresses are not used to track your session and are not linked to anything personally identifiable.

7.2 A feature known as a cookie is also used. A cookie is a small data file that resides on your computer which allows Euromonitor to recognise you as a user when you return to the Site using the same computer and web browser. The cookies and other automatically tracked information are used:

  • to identify repeat visitors;
  • to personalise your experience on the Site;

The Site contains links to third party websites that are not subject to this Privacy Policy. Euromonitor strongly recommends that you read the privacy policy of any such websites that you visit.

9. SECURITY

Encryption creates billions of code combinations to protect each transaction made on the Site, so your details cannot be viewed by anyone else using the internet.
